Art Contact Artist Terms and Conditions
These terms are the agreement between Art Contact Ltd and you as the artist.
1 Introduction
These terms and conditions should be treated as an agreement between Art Contact Ltd (us) and the Artist (you). By allowing Art Contact Ltd to represent you, you agree to be bound by these terms and conditions.
Art Contact reserves the right to change these terms and conditions from time to time. Changed terms and conditions will be displayed on the Art Contact website and will have immediate effect.
2 Application
Visit the Artist page on our website for further details on how to submit an Artist Application.
Complete the Artist Application Form which can be completed in the artist section on our website.
Submit between 5 and 10 jpeg images showing the range of work that you do.
Please send images via the HIGHTAIL File Transfer Link on our website not by e-mail. Please ensure that the file name of each image includes the name of the artwork, its dimensions and the sale price. Using this format — Artwork Name-width x height mm-£XXX
Your work will then be presented to our Selection Committee.
Successful applicants should be notified within 6 weeks.
If your application has been successful, we will send you a link to our Artist Information Form that you will need to complete so that we have your details on file.
3 What we will do
Include you and your work on our website and database as appropriate — Art Contact Ltd specialising in sourcing and supplying art to working and other environments.
Promote your work to our clients when appropriate.
Act as your Commissioning Agent for our clients if this is required.
We may include your work in the Artist Directory on our website, on our main database and the private sales section of our website which will only be accessible to our clients.
When appropriate we will put your work forward for sale to our clients and if successful to sell your work at the agreed price.
We may include your work in one of our web shops (under construction) and also in our rental and subscription programmes.
4 What you will do
Advise us of any artwork you would like us to include on our database by completing the Artwork Form which will be sent to you upon request and by sending us jpeg images via the HIGHTAIL File Transfer Link on our website.
Advise us of any new work you would like us to include in our database again by completing the Artwork Form which can be accessed from the Services for Artists page on our website and by sending us jpeg images via the HIGHTAIL File Transfer Link on the Services for Artists page on our website.
Advise us of developments in the style of your work.
Advise us in writing by email of any price changes.
Advise us when you will not be available to take on commission work.
Advise us immediately of any delays in the production or variances to the artwork that has been commissioned.
Agree not to sell your work for less than the retail price agreed with us for each piece of work.
Agree not to sell direct to any of our clients to whom we have already sold, commissioned or rented your work or included your work on a client portfolio or in a client subscription scheme. In all these circumstances you will have been informed of our involvement with the client prior to our submission of your work to them. In the event that you are approached by one of our clients you will refer them to us and notify us that you have been approached by them.
Advise us in advance about your upcoming exhibitions.
Regularly review your information on our website and on the private sales section for which you will have log-in details. Advise us of any additional information or to request changes to the artwork displayed.
5 Rental & Subscription Schemes — Optional
Your work can be included in our rental and art subscription schemes.
Artworks can be rented for any period by specific agreement with the artist and the client.
Payment for rented artwork is by agreement with you but would normally be a percentage of the value of the work paid quarterly for the time that the work is rented.
Your work can be included in the subscription scheme for any period but if the artist requires the work to be returned then sufficient notice must be given to allow artworks to be returned from the client at the end of the subscription period.
Payment for artworks included in the subscription scheme is by agreement with you but would normally be a percentage of the value of the work paid quarterly for the time that the work is included in a client subscription scheme, usually not less than 3 months.
The cost of framing is included in the rental or subscription charged to the client. If Art Contact has framed the work and it is required back by the artist prior to rent/subscription received having paid for the frame then the artist will pay any outstanding framing charge.
6 Non-Exclusivity
The works displayed, consigned to or otherwise offered by Art Contact are not exclusive and the Artist retains the right to sell or display their pieces through other agents or dealers but agrees not to sell any work for less than the retail price agreed with us for each piece of work.
The Artist must inform Art Contact immediately when a picture is no longer available.
When Art Contact notifies you that a particular item has been included in a portfolio for a client then we would ask you to reserve that artwork for up to 90 days or until we notify you that the artwork is not required.
7 Copyright
All copyright and other intellectual property rights in the artworks displayed by, consigned to or otherwise offered by Art Contact Ltd remains with the artist.
Art Contact is granted the use of digital images of your artworks for the purpose of selling and promoting your work either through our website, image database or any other means.
Although we will endeavour to prevent the infringement of these rights Art Contact cannot be held responsible for any infringement.
Art Contact will not be liable for any loss or damage caused to the Artist by any infringement of these rights.
8 Consignment Stock
All artworks and samples consigned to Art Contact must be recorded on our Consignment Form which will be sent to you for completion by the artist. If you are unable to complete the form, then we can do this and in either event we will send you a copy of the form once we have included it on our database.
The prices recorded on the consignment form are the prices that will be included on our database for sale purposes.
The artist must notify Art Contact in writing of any price changes. Such price changes will not affect any items included on a portfolio at that time.
All consigned artworks and samples remain with Art Contact at the owner’s risk.
9 Artworks not on Consignment
All artworks submitted to Art Contact for inclusion in our database must be recorded on our Artwork Form or Spreadsheet which will be sent to you for completion by the artist and by sending us jpeg images via the HIGHTAIL File Transfer Link on our website.
The Artist and Retail Prices used on our database must be agreed in writing prior to inclusion usually by the submission of an Artwork Form or Spreadsheet or by the exchange of emails.
The artist must notify Art Contact in writing of any price changes. Such price changes will not affect any items included on a portfolio at that time.
When Art Contact notifies you that a particular item has been included in a portfolio for a client then you must reserve that artwork for 90 days or until we notify you that the artwork is not required.
For the avoidance of doubt the sales procedure for works not consigned to Art Contact will be the same as for works that are consigned to Art Contact. (See section 12 below)
10 Specifically Commissioned Works of Art
Details for the specific commissioning of works of art will be agreed with the artist at the time that the contract for the commission is agreed with our client.
For the avoidance of doubt, the artist agrees that when informed that Art Contact is entering into negotiations with a client on their behalf that that client is Art Contact’s client. The artist will not enter into any agreements for the supply of artworks with that client, will refer that client to Art Contact and notify Art Contact that they have been approached by them.
11 Delivery and Return
The artist will arrange and pay for the packaging and delivery of all items to Art Contact or the client unless specifically agreed in writing in advance of the delivery.

In the event that artworks arrive damaged then Art Contact will notify the artist as soon as possible so that the artist can send a replacement.
12 Sales Procedure
In the event of sales for works consigned to Art Contact:
Art Contact will notify the artist by sending an advice note at the end of the month in which an artwork is sold.
Upon receipt of this advice note the artist will send an invoice (including VAT if applicable) for the agreed artist’s price for that artwork.
Invoices to be sent by email to artists@artcontact.co.uk with a copy to the consultant that arranged the sale.
Art Contact will pay the Artist’s invoice at the end of the month following the month of invoice provided that Art Contact has been paid by its client.
In the event of rentals and inclusion in our Subscription Scheme:
Art Contact will notify the artist when their work has been rented or included in our subscription scheme and for how long.
The artist will send invoices (including VAT if applicable) quarterly for the duration of the rental or subscription scheme.
Invoices to be sent by email to artists@artcontact.co.uk with a copy to the consultant that arranged the rental/subscription scheme.
Art Contact will pay the Artist’s rental/subscription invoice at the end of the month following the month of invoice provided that Art Contact has been paid by its client.
13 Art Contact Commission on Sales
Art Contact charges Commission on all sales, rentals and artwork subscription schemes.
Our commission is specific to the individual artwork and is the difference between the retail/sale price and the artist price as shown on our database record for that artwork. The artist is able to view the prices we have on our system by logging in to their section on our database.
Our normal commission on sales is 50% of the retail/sale price or as agreed by negotiation with the artist.
Commission on Rentals and Subscription Schemes is specifically agreed with the artist in writing at the time that the rental or subscription scheme is agreed with our client. It is normally based on the commission agreed for that artwork as shown on the artwork record with the artist receiving the same proportion of the rental fee for the artwork for the duration of the rental or the period that the artwork is included in the subscription scheme.
Our fee for the specific commission of works of sculpture and other artworks is agreed in writing with the artist and the client when the contract for the commission is agreed.
14 Framing
Art Contact framing services are available to all our artists at very competitive reduced rates. We specialise in medium run framing most suitable for framing artworks for exhibitions.
15 Notices
All notices will be given by e-mail and shall be deemed as received on the day that they are sent by Art Contact. All e-mails sent by the artist will not be deemed as received until Art Contact confirms the receipt of the e-mail and its contents.
16 Governing Law and Jurisdiction
This agreement shall be governed by English Law and shall be subject to the jurisdiction of the English Courts.
